Mudboard Terms and Conditions, Copyright Policy and Privacy Policy

Market Place Terms and Conditions

The Mudboard Market Place is from herein referred to as "the Market Place". A User that sells an item or intends to sell an item in the Market Place is herein referred to as a "Seller". A User that buys an item in the Market Place is referred to as a "Buyer"

  1. Compliance with current terms and conditions
    1. You understand and agree that the use of the Market Place is in complete compliance with the terms and conditions set out in the Mudboard User Agreement, and that the conditions of use of the Market Place are additional to, and not intended as a replacement for the Mudboard User Agreement. By Agreeing to the Mudboard User Agreement You also agree to be bound by:
      1. The Terms of the Market Place
  2. Market Place as a venue
    1. The Market Place acts as a venue to allow Users registered with Mudboard to offer, sell and buy certain original creative content (as set out in our Content Policies) within a fixed-price format. As a result Mudboard has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of Sellers to sell items or the ability of Buyers to pay for items. Mudboard does not pre-screen users or the content or information provided by Users.
    2. Mudboard does not transfer legal ownership of items from the Seller to the Buyer.
    3. Mudboard cannot guarantee the true identity, age and nationality of a User.
    4. Mudboard encourages the Seller to communicate directly with potential transaction partners through tools available on the Website.
  3. Account Information
    1. To sell items in the Market Place, You must provide and maintain valid payment information, such as a valid email address linked to your PayPal account.
  4. Fees and Payments
    1. Mudboard does not charge a fee for listing an item intended for sale in the Market Place. However, We may in Our sole discretion, for any or no reason, charge a fee for listing an item intended for sale in the Market Place, at any time.
    2. You understand and agree that if a User purchases Your content or Item(s) through the Market Place We automatically deduct 7% commission fee from the sale price (this does not include the shipping price).
    3. Payments between Buyer and Seller are through a third party, such as PayPal, and as a result Mudboard does not handle any disputes involving payments, such as a transaction dispute, non-receipt of a purchased item.
    4. Mudboard does not request or store any credit card details.
  5. Shipping
    1. Sellers may charge reasonable shipping and handling fees to cover the costs for packaging and mailing the items. Sellers may not charge excessive shipping fees or otherwise avoid fees.
    2. Selling items on the Website is permitted by Users residing in Australia and Users residing outside of Australia.
    3. It is the responsibility of the Seller to set the appropriate local and international shipping fees using the tools provided by the Website.
  6. Seller Responsibility
    1. To list an item intended for sale in the Market Place You must provide Us with a valid contact name, current residential or business address and a valid email address that is linked to a third party payment account as specified by Us, such as PayPal.
    2. By listing an item on the Website you warrant that you may legally sell the item.
    3. You must accurately describe, including text descriptions, graphics, pictures and other relevant content, an item listed for intended sale in the Market Place. Also, You must tag the item correctly.
    4. All items listed with an "in stock" quantity of greater than one (1) must be identical
    5. Any item that has an "in stock" quantity of zero (0) will be displayed in the Website, but unavailable for purchase.
    6. Each unique item must have its own listing.
    7. The Seller must ensure that the item listed for sale is available for purchase by a Buyer.
    8. The price stated in each item listing description must be an accurate representation of the sale.
    9. The Seller is responsible for shipping the item to the Buyer within an agreed time frame (as a guideline within 5 working days).
    10. The Seller must notify a Buyer, using communication tools available in the website, if an item purchased will not be able to be sent within an agreed time frame.
    11. Any Seller determined to have received payment for an item but fails to send it may as a result be banned from the Website, unless there is exceptional circumstance, such as: the Buyer fails to meet the terms of the Seller’s listing, such as payment method; or the Seller cannot authenticate the Buyer’s identity/ shipping address.
    12. When the Seller has sent an item to the Buyer the Seller must, using tools provided on the Website, notify the Buyer.
  7. Buyer Responsibility
    1. When the Buyer has received an item from the Seller the Buyer must, using tools provided on the Website, notify the Seller to complete the transaction.
    2. The Buyer is responsible for ensuring their shipping address is specified correctly when making a purchase.
    3. The Buyer is responsible for making payment to the Seller using the payment method specified for that particular transaction.
  8. Legal Compliance
    1. As Mudboard does not directly make payments to You, You are responsible for paying any taxes applicable to any purchases or sales of items you make on the Website.
